PRESTIGIOUS HAITIAN MUSIC AWARDS (PHMA)
TERMS & CONDITIONS – PHMA 2027
1. ACCEPTANCE OF TERMS
By submitting an entry, nomination, application, or supporting material to the Prestigious Haitian Music Awards (PHMA), the submitter acknowledges that they have read, understood, and agreed to these Terms & Conditions.
Participation in the PHMA submission, nomination, judging, and voting processes constitutes acceptance of the applicable PHMA rules.
2. ELIGIBILITY
All submissions must satisfy the eligibility requirements established for the applicable award category.
PHMA reserves the right to determine whether an entry meets the eligibility requirements and to request additional information or documentation when necessary.
Meeting the minimum eligibility requirements does not guarantee nomination.
3. ACCURACY OF INFORMATION
All information provided to PHMA must be truthful, accurate, complete, and verifiable.
The submitter is responsible for the accuracy of:
- Artist names
- Band names
- Song and album titles
- Release dates
- Credits
- Performance information
- Event information
- Streaming and media links
- Contact information
- Supporting documentation
Providing false, misleading, fraudulent, or intentionally inaccurate information may result in rejection or disqualification.
4. SUBMISSION OF MATERIALS
By submitting materials, the submitter confirms that they have the authority to submit the material to PHMA.
Submitted materials may include music, videos, photographs, biographies, promotional materials, links, credits, and other information necessary for award consideration.
PHMA may use submitted materials for legitimate award-related purposes, including evaluation, verification, promotion, nominee announcements, and award-related communications.
5. INTELLECTUAL PROPERTY
The submitter represents that they own, control, or have obtained the necessary permissions and rights to submit any copyrighted material provided to PHMA.
PHMA does not claim ownership of an artist’s music, recordings, videos, photographs, trademarks, or other intellectual property merely because those materials are submitted.
The submitter remains responsible for obtaining any permissions required from copyright owners, artists, labels, publishers, producers, photographers, or other rights holders.
6. USE OF NAME, IMAGE & SUBMISSION MATERIALS
By participating in PHMA, nominees and participants authorize PHMA, where legally permitted, to use their professional name, approved biography, photographs, likeness, submitted materials, award category, and publicly available professional information for purposes related to:
- PHMA website
- Social media
- Promotional campaigns
- Press releases
- Nominee announcements
- Award programs
- Promotional videos
- Television and digital broadcasts
- PHMA events and marketing materials
PHMA will not use submitted materials for unrelated commercial purposes without appropriate authorization where such authorization is legally required.
7. CATEGORY CLASSIFICATION
PHMA reserves the right to determine the appropriate category for a submission.
If a submission does not meet the requirements of the selected category but appears eligible for another category, PHMA may reclassify the submission where appropriate.
PHMA may also decline an entry if no applicable category is appropriate.
8. REVIEW & VERIFICATION
PHMA may independently verify information provided in submissions.
Verification may include reviewing:
- Official music platforms
- Digital releases
- Music videos
- Event records
- Ticketing information
- Media coverage
- Social media activity
- Performance records
- Publicly available information
- Supporting documentation
PHMA may request additional evidence when necessary.
9. NOMINATION
Submission does not guarantee nomination.
PHMA will determine the nominees based on the official eligibility requirements, review process, judging procedures, and other applicable award rules.
PHMA reserves the right to limit the number of nominees in any category.
10. JUDGING
PHMA may use a qualified judging panel, voting body, industry professionals, or other approved mechanisms to evaluate submissions.
Judges may consider factors including artistic quality, originality, performance, impact, professionalism, consistency, audience response, and category-specific criteria.
PHMA reserves the right to establish and modify judging procedures when necessary to protect the integrity of the awards.
11. VOTING
Where public voting applies, all votes must be submitted through the official PHMA voting system.
PHMA may establish rules concerning:
- Voting periods
- Number of votes permitted
- Voting eligibility
- Paid voting, where applicable
- Voting fees
- Payment processing
- Vote verification
- Fraud prevention
PHMA reserves the right to reject, remove, or invalidate votes that it reasonably determines to be fraudulent, automated, manipulated, duplicated, or obtained in violation of the official voting rules.
12. VOTING INTEGRITY
Participants may not use fraudulent methods to influence voting results.
Prohibited conduct may include:
- Automated voting
- Bots
- Fake accounts
- Vote manipulation
- Unauthorized software
- Fraudulent payment activity
- Misrepresentation
- Attempts to interfere with the voting system
PHMA may investigate suspicious voting activity and take appropriate action, including vote removal or disqualification.
13. PAID VOTING
If PHMA offers paid voting, payment for votes does not guarantee that a nominee will win an award.
All paid votes must be processed through the official PHMA voting platform and must comply with the applicable voting rules.
Votes associated with fraudulent or unauthorized transactions may be invalidated.
All applicable fees, limits, and payment terms will be clearly communicated through the official voting platform.
14. DISQUALIFICATION
PHMA reserves the right to disqualify a submission, nominee, participant, or voting activity if there is evidence of:
- False information
- Fraud
- Ineligibility
- Copyright or rights violations
- Voting manipulation
- Misrepresentation
- Violation of PHMA rules
- Unprofessional conduct that materially compromises the integrity of the awards
PHMA may also remove a nominee from consideration if information submitted is subsequently determined to be inaccurate or ineligible.
15. DEADLINES
All submissions must be received by the official PHMA deadline.
PHMA may extend, modify, or close submission periods when necessary.
Participants are responsible for ensuring that their submissions are completed before the applicable deadline.
16. CHANGES TO THE AWARDS
PHMA reserves the right to modify, suspend, postpone, or cancel any category, submission period, voting period, event, or award procedure when circumstances require it.
Changes may be made to protect the fairness, security, integrity, or proper administration of the awards.
17. NO GUARANTEE OF NOMINATION OR AWARD
Participation in PHMA does not guarantee:
- Nomination
- Public voting eligibility
- Finalist status
- Award placement
- Media exposure
- Performance opportunities
- Sponsorship
- Promotion
All decisions are subject to the official PHMA rules and procedures.
18. EVENT CHANGES
PHMA reserves the right to change the date, location, format, schedule, or other details of the awards ceremony when necessary.
Participants and ticket holders will be notified through official PHMA communication channels when reasonably possible.
19. LIMITATION OF LIABILITY
To the extent permitted by applicable law, PHMA and its organizers, officers, directors, staff, volunteers, judges, partners, and representatives shall not be responsible for losses arising from circumstances beyond their reasonable control, including technical failures, internet outages, payment-processing interruptions, unauthorized access, force majeure events, or other circumstances affecting the administration of the awards.
20. PRIVACY & PERSONAL INFORMATION
Information collected during the submission, nomination, registration, or voting process may be used for purposes necessary to administer the PHMA program.
Participants should review PHMA’s applicable Privacy Policy for information regarding the collection, use, storage, and protection of personal information.
21. THIRD-PARTY SERVICES
PHMA may use third-party services for website hosting, payment processing, ticketing, voting, streaming, communications, analytics, or other operational functions.
Use of third-party services may be subject to the applicable terms and policies of those providers.
PHMA is not responsible for the independent policies or practices of third-party service providers.
22. OFFICIAL COMMUNICATION
Official PHMA announcements, deadlines, voting information, nominee announcements, and rule updates will be communicated through PHMA’s official communication channels.
Participants are responsible for keeping themselves informed of applicable updates.
23. PROFESSIONAL CONDUCT
All nominees, participants, representatives, judges, volunteers, and partners are expected to conduct themselves professionally and respectfully.
Harassment, threats, discrimination, intimidation, fraud, or deliberate interference with PHMA operations may result in removal from participation or other appropriate action.
24. FINAL AUTHORITY
PHMA reserves the right to interpret and enforce these Terms & Conditions and the official award rules.
Except where an applicable appeals process is expressly provided, decisions concerning eligibility, category placement, nominations, voting integrity, and award administration are final.
25. AGREEMENT
By submitting an entry, participating as a nominee, voting, or otherwise participating in the PHMA 2027 program, the participant confirms that they have read and accepted these Terms & Conditions and agrees to comply with the official PHMA rules.
